Claiming UIF after retrenchment

UC SITUATION GUIDE UIF After Retrenchment uifcalculator.com — UIF made simple for South Africa

Retrenchment is one of the clearest cases where you can and should claim UIF — you lost your job through no fault of your own, which is exactly what the fund is for. But retrenchment also comes with severance pay and other entitlements, and knowing how they fit together helps you plan.

Yes, you can claim

Retrenchment (a dismissal for operational reasons) qualifies you for unemployment benefits, provided you contributed. Your UI-19 form should record the reason as "retrenched" or "operational requirements" — check this, because a wrong code can block your claim.

Severance pay vs UIF — they're separate

Severance pay (at least one week's pay per completed year of service) comes from your employer and is your right under the Basic Conditions of Employment Act. UIF is separate, comes from the fund, and does not reduce your severance. You are entitled to both.

How much UIF will you get?

Your benefit uses the 38–60% income replacement rate applied to your salary (capped at R17,712), paid for as many credit days as you have built up. Someone with four-plus years of service can receive up to about 12 months of benefits. Estimate yours on the payout page.

Act fast — the six-month rule

You must apply within six months of your last working day. Do not wait for severance negotiations to finish; you can lodge the UIF claim straight away.

Step by step

A worked retrenchment example

Take Sibusiso, retrenched after five years on R14,000 a month. He received severance (at least a week's pay per year of service) from his employer, and separately claimed UIF — about R5,500 a month based on his salary and his maxed-out credit days, for close to a year. The two did not affect each other.

The order of events that works best

A mistake retrenched workers make

Some delay claiming because they received severance and assume they must "use it up" first. Not true — UIF and severance are separate, and the six-month clock is ticking. Claim straight away.

If you dispute the retrenchment

Claiming UIF does not stop you challenging an unfair retrenchment at the CCMA. The two are separate processes.
